    1. 1. The prize draw is open to all organisations registered for Active Kids 2012 who place their order online. Only one entry per organisation.
    2. 2. Your Active Kids order and vouchers must be received no later than 5 June 2012.
    3. 3. Ten winners will be drawn at random by an independent adjudicator from all completed Active Kids 2012 orders placed online and the winner will be notified no later than 1 September 2012 by telephone or email.
    4. 4. There are 10 prizes of 5000 Active Kids vouchers to be won.
    5. 5. There is no cash alternative to the stated prize.
    6. 6. The vouchers must be used for Active Kids 2013.
    7. 7. To obtain the name and town of the winners, send a stamped self-addressed envelope to Active Kids Free Prize Draw – Online Orders, Granby Marketing Services, Stanley Street, Blackburn, Lancashire BB1 3BW.
    8. 8. The decision of the promoter in all matters is binding and final and no correspondence will be entered into.
    9. 9. The promoter is Sainsbury’s Supermarkets Ltd, 33 Holborn, London EC1N 2HT.
  • D. Active coaching sessions

    1. 1. You will need to collect the relevant number of AKVs for your chosen active coaching session as specified in the catalogue. Then, simply complete the order form and send in your AKVs as specified in section B.
    2. 2. Once your order has been verified, we will send a letter to your Organisation with details of how to book.
    3. 3. The active coaching sessions are valid until 31 July 2013.
    4. 4. You should confirm the class/group size and ages as well as indicating whether you have any specific conditions or requirements for participating children when booking your coaching session. For Fitness Training, Cheerleading and Dance coaching sessions the class/group size is limited to a maximum of 30. For Martial Arts sessions the class/group size is limited to a maximum of 25. Remember to quote your unique reference number.
    5. 5. Active coaching sessions must be booked a minimum of 28 days in advance. A letter will be sent out containing the coach’s name and contact details as confirmation of the booking. This letter must be retained and shown to the coach upon request. If a valid booking form is not shown the instructor reserves the right not to give the session. The letter will also include a ‘Satisfactory completion of sessions’ form, which should be completed after the session(s) has been completed-see clause 10.
    6. 6. Once a booking has been made it is the Organisation’s responsibility to liaise with the coach with regard to any changes that are necessary.
    7. 7. The Organisation is responsible for ensuring that all necessary equipment is available for the session and ensuring that everything is suitable with the coach.
    8. 8. No equipment will be provided for the running of the session by the promotion organiser. Other equipment loans are at the discretion of the coach or the coach’s club.
    9. 9. Some activities are not suitable for all children, please tell the coach in advance if you have any specific conditions or requirements for participating children. The coach will then advise if the activity is suitable for them.
    10. 10. The ‘Satisfactory completion of sessions’ form should be presented to the coach at the end of the session with a signature from the Organisation leader who is in charge.
    11. 11. The content of the activity may vary depending on the chosen session. Session duration is one hour.
    12. 12. Individuals taking part in any active coaching session take part at their own risk. It is recommended that schools contact their LEA to discuss the appropriate insurance requirements.
    13. 13. If booking a Judo coaching session, special Judo mats may be required for safety.
    14. 14. Should the Organisation or LEA have specific insurance requirements regarding Personal Indemnity Liability Insurance cover, please check with the instructor a minimum of 14 days before the session.
    15. 15. Instructors with CRB checks will be provided.
    16. 16. Images and descriptions of the active coaching sessions as described in the promotional literature are intended as a guide and may not accurately reflect the coaching session provided.
    17. 17. All information detailed is subject to change throughout the promotion and correct at time of going to print.
    18. 18. Participation in an active coaching session implies acceptance of the terms and conditions.
  • E. PGL adventure courses

    1. 1. The offer is based on 25% off multi-activity weekends and/or mid-week bookings (on both course durations (PGL Day Camps and PGL Full Courses), as quoted in 2012/13 PGL brochure prices (excluding VAT), for travel between 23 July 2012 and 1 June 2013 only. Day Camps only operate on Monday.
    2. 2. The offer is subject to availability and cannot be used retrospectively.
    3. 3. This offer cannot be used in conjunction with any other offer or discount.
    4. 4. PGL booking terms and conditions apply. Please refer to www.pgl.co.uk for full terms and conditions.
    5. 5. Once the booking is made, all contact and administration is through PGL.
    6. 6. Customers must advise at the time of booking, that they will be redeeming AKVs.
    7. 7. The minimum group size is 12 children.
    8. 8. Offer only applies to multi-activity courses in the UK.
  • F. Active equipment and kits

    1. 1. General
      1. 1.1 The details in the catalogue explaining the Sainsbury’s Active Kids campaign should be read in conjunction with these Conditions of Supply.
      2. 1.2 Terms 1-13 of the active equipment and kit terms and conditions apply to all orders placed by Organisations for goods. The Organisation accepts all of the active equipment and kit terms and conditions herein by placing an equipment order. The parties to the Supply Contract (‘the Contract’) are the Organisation and the appropriate supplier/contractor. Sainsbury’s is not a party to the contract.
    2. 2. The products
      1. 2.1 Products in the Sainsbury’s Active Kids catalogue (‘goods’) will be marked as to the number of AKVs needed. A registered Organisation will order goods from the catalogue in the manner prescribed in the catalogue. Goods will be delivered to the Organisation from the relevant supplier (‘Supplier’) named in the catalogue.
      2. 2.2 Once an order has been placed, it cannot be changed or cancelled.
      3. 2.3 The Supplier reserves the right to substitute an alternative product of a similar or greater value and equivalent to the type ordered, provided that the substitution does not prejudice the Organisation, if for any reason the chosen goods have been discontinued or are not available.
      4. 2.4 The goods in the catalogue are supplied only for use in Organisations and not for export or resale.
    3. 3. Active Kids vouchers (AKVs)
      1. 3.1 The number of AKVs required for an item in the Sainsbury’s Active Kids catalogue is non-negotiable.
      2. 3.2 AKVs must be redeemed and orders received by the Handling House by 5 June 2012.
    4. 4. Customer helpline
      1. 4.1 The relevant Active Kids supplier has provided contact details (08451 243 633) for queries arising in connection with goods ordered from and supplied by the supplier in the Sainsbury’s Active Kids catalogue.
      2. 4.2 The Active Kids helpline will be available Monday to Friday (excluding public holidays) between 9am and 5pm on 0844 415 8440.*
    5. 5. Delivery, orders and prices
      1. 5.1 Delivery will be made to the Organisation named on the order form by October half term 2012. All efforts will be made to make all deliveries on time. In the event of a delay, Organisations will be informed in writing.
      2. 5.2 Delivery may be made in instalments. Each package or delivery note will clearly state the goods contained therein for ease of reference.
      3. 5.3 The Organisation is responsible for installing goods in accordance with the supplier’s instructions and will bear the risk of any loss or damage to the goods from the point of delivery.
      4. 5.4 No claim for damage or shortage will be considered unless the Supplier is advised in writing within 21 days of delivery. In the absence of such advice the Organisation will be deemed to have accepted the goods.
    6. 6. Property in the goods
      1. 6.1 Risk in the goods shall pass to the Organisation when the goods are delivered to that Organisation.
    7. 7. Assignment
      1. 7.1 The Supplier may assign its rights and obligations under the Contract to another company within the Supplier’s Group. The Organisation may not assign any of its rights and obligations under the Contract without the appropriate Supplier’s prior written consent.
    8. 8. Cancellation
      1. 8.1 The Organisation is not entitled to cancel, extend or delay this Contract or part thereof, nor is it entitled to change its order or obtain credit, whether in AKVs or cash, in any respect of any goods returned.
    9. 9. Promotional material
      1. 9.1 No drawings, descriptive matter, weights or dimensions issued by the supplier or the manufacturer of the goods, nor the descriptions and illustrations contained in the catalogue or other promotional material will form part of the Contract nor be regarded as a warranty or representation relating to the goods.
    10. 10. Force majeure
      1. 10.1 Neither party will be liable for failure or delay in delivery or performance of their obligations under this Contract due to any cause beyond their reasonable control.
    11. 11. Governing law
      1. 11.1 This Contract and any order placed hereunder shall be governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the English Courts.
    12. 12. Warranty
      1. 12.1 The Suppliers warrant that all goods supplied comply with existing EC/UK legislation and standards.
    13. 13. Guarantee and limitations
      1. 13.1 Where the Supplier is not the manufacturer of the goods or ultimate licensor of the software (as appropriate) the Supplier will endeavour to transfer to the Organisation, the benefit of any warranty or guarantee given by the manufacturer or ultimate licensor.
      2. 13.2 Unless the Supplier has notified the Organisation otherwise, the Supplier will repair, or at its option, replace any goods manufactured by the Supplier (other than software) that are proved to the reasonable satisfaction of the Supplier to be defective in material and workmanship (fair wear and tear excepted), provided such defects are notified to the Supplier within 12 months of the date of dispatch.
      3. 13.3 The obligations set out in clause 13.2 will not apply where:
        1. 13.3.1 The goods have been altered (otherwise than by the Supplier) in any way whatsoever or have been subjected to misuse or unauthorised repair; or
        2. 13.3.2 The goods have been improperly installed or connected (unless the Supplier carried out such installation and connection); or
        3. 13.3.3 The Organisation has failed to observe any maintenance or storage requirements relating to the goods which have previously been communicated to the Organisation by the Supplier; or
        4. 13.3.4 The Organisation has failed to notify the Supplier of any defect or suspected defect within 28 days of the same coming to the notice of the Organisation.
      4. 13.4 Any goods returned after replacement will belong to the Supplier. Any repaired or replacement goods will be guaranteed on these terms for the original guarantee period. Warranties on repaired or replacement goods will expire at the end of the original warranty period.
      5. 13.5 Save as provided in clauses 13.1 and 13.2 the Supplier will be under no liability under the Contract for any consequential loss or damage or otherwise, including, but not limited to, loss of profits, manufacture or supply of the goods or in any connection with any statement given or made (or advice not given or made) by or on behalf of the Supplier.
      6. 13.6 The Organisation is responsible for ensuring that faulty goods returned to the Supplier for repair or replacement are free from biological, chemical and radioactive hazard. The Supplier reserves the right to refuse to accept goods which in its view present a hazard to its staff or which may infringe Health and Safety at Work legislation or which are without a signed certificate that the effective disinfection or decontamination has been carried out.
  • G. Nectar

    1. 1. Nectar points can be redeemed for AKVs in multiples of 500 points only. For every 500 points redeemed, 50 AKVs will be added to the balance of the Organisation nominated at the time of the redemption. No redemptions can be made after 8pm on 4 April 2012 (inclusive).
    2. 2. Nectar points can only be redeemed for AKVs online at nectar.com or by calling the Nectar helpline on 0844 811 0811. Calls to Nectar are charged at national rate and may be recorded for training purposes.
    3. 3. Nectar points donated as AKVs will automatically be added to the voucher balance of the Organisation nominated by the customer/ account holder. Final additions will be made shortly after 4 April 2012. All additions are subject to sufficient points being available in the customer’s Nectar account at the time of processing.
    4. 4. The Organisation must be registered to Active Kids to be entitled to receive any benefits under the campaign. An Organisation cannot be donated to if it is not registered to Active Kids.
    5. 5. If your chosen Organisation is not listed in the list of Organisations on the redemption pages, please advise a member of your Organisation’s staff to visit sainsburys.co.uk/activekids/registration or call 0844 415 8440 to register.

Active Kids Get Cooking Terms and Conditions

    1. 1. By participating in Active Kids Get Cooking your school or Scout group (defined as Beavers, Cubs, Scouts, Explorers and Scout Network) (‘School’, ‘Group’) (‘Organisation’), is confirming agreement to allow us to automatically renew your registration on a yearly basis and communicate with you about future schemes. If after one year you no longer wish to benefit from the scheme, please write to Sainsbury’s Active Kids Get Cooking, PO Box 100, Blackburn BB2 9FL.
    2. 2. By registering for Active Kids Get Cooking your Organisation is confirming agreement to the Active Kids Get Cooking terms and conditions.
    3. 3. Participation is restricted to nurseries, schools and Scout groups in the UK and Republic of Ireland only.
    4. 4. If your nursery, school or Scout group has not already registered, please advise a teacher from the nursery, school or Scout group leader to visit sainsburys.co.uk/activekids/registration to register.
    5. 5. Organisations also selecting to register with ‘Active Kids’ must accept the Active Kids terms and conditions.
    6. 6. The Primary and Secondary school awards and Scout toolkit have been developed in conjunction with the British Nutrition Foundation. Teachers and Leaders should use the award toolkits and toolkits using their own discretion, modifying where necessary to take into account their class/groups specific needs, including allergens, cultural differences etc. Teachers and Group Leaders must exercise an appropriate level of supervision when children and young people in their care engage in Active Kids Get Cooking activities.
    7. 7. By participating in the scheme, Organisations consent to Sainsbury's Supermarkets Ltd using their school or Scout group details in local press and publicity materials to promote the scheme.
